Over 60% of all people killed in car accidents are not wearing a seatbelt, according to the National Highway Traffic Safety Administration (NHTSA). In contrast, close to 10,000 people survive car accidents every year thanks to proper seatbelt usage. When you consider that seatbelts are only used by 81% of all drivers, the amount of lives that could potentially be saved if 100% of people used them is a staggering number.

Personal injury is still possible if you are wearing a seatbelt in a car accident, but the odds of you suffering a severe, life-changing injury are greatly reduced. Unfortunately, defective seatbelts can nullify these benefits, potentially contributing to serious injuries. Defective seatbelts can be caused by issues like:

  • Design flaws
  • Improper labeling
  • Insufficient directions
  • Assembly errors

Over the past 10 years, over 1,000 different defective seatbelt recalls have occurred. If you have been seriously injured in a car accident because of a seatbelt defect, you may be able to hold the manufacturer responsible for your losses.

If you or your loved one have been injured in any type of car accident because of someone else’s negligence, please contact Kalfus & Nachman today to schedule a free case evaluation with one of our experienced Norfolk brain injury attorneys.

Traumatic brain injury (TBI) has become one of the signature injuries of the war in Afghanistan and Iraq. Thousands of soldiers have returned home with brain injuries. Thankfully, improved research has led to an increased awareness of TBI and PTSD in war veterans. The symptoms of TBI and PTSD often overlap: both conditions can cause behavioral changes, confusion, memory loss, and sleep problems.

TBI and PTSD often occur in soldiers who are hurt in explosions caused by IEDs (Improvised Explosive Devices), which are common weapons used in these wars. A recent study revealed that brain injury increased the prevalence of sleep disorders in veterans. Specifically, soldiers with TBI from explosions were more likely to experience insomnia and/or fragmented sleep, whereas soldiers with TBI from blunt force trauma were more likely to experience daytime sleepiness, obstructive sleep apnea, or chronic drowsiness.

The link between brain injury and PTSD underscores our need for better screening processes for veterans who are returning home from Afghanistan or Iraq. If your loved one has been affected by a sleep disorder related to PTSD, it’s a good idea to consult your doctor about whether or not a brain injury is contributing to the problem.

If you or one of your loved ones has suffered a brain injury because of someone else’s negligence or recklessness, please contact Kalfus & Nachman today to schedule a free case evaluation with one of our experienced Norfolk brain injury attorneys.

As attorneys, we want to take every opportunity to give back to the community and help children in our area. We spent some time with kids in our area recently discussing bicycle safety.

The main concern we talked about is how much every child needs to wear a bicycle helmet. This is the number one tip on how to keep your children safe while riding their bikes, scooters, and even other recreational equipment.

Helmets come in all shapes and sizes but the best option would be one that covers at least three-fourths of your child’s head. These are much safer and can really be a lifesaver. Along with a great helmet, we talked about how wearing good clothing can also prevent accidents. Reflective clothing can be seen by any passing automobiles and even wearing light colored tops and pants can keep you visible to passerby. Kids should also be equipped with headlights and flashlights which can be installed on their bicycles or helmets. We also wanted to let the children know that some other tips such as riding their bike in the same direction of traffic and staying away from busy streets with traffic lights. Bicycle safety is very important and learning how to be safe can not only stop someone from being injured but even save a life. Watch the video now to learn more.

After your car accident, your vehicle may not be ready to drive and may have some major damage. You may be wondering how you’re going to get to work, run errands and live your everyday life without a car.

For most people, one option is to get a rental car. Under your insurance policy, you may have already purchased the ability to rent a car in case of an accident. This is pretty typical. But you may also be able to do this by charging it to the other driver’s insurance company if you don’t have this coverage yourself.

When you go to rent a car by using your insurance policy, you should be getting a rental that is in like kind of your own type of vehicle. What this means is that you will be renting something very comparable to your own vehicle. They have to fulfill your needs whether you use the car for personal and/or business use. You will be able to use this rental vehicle until they complete repairs on your car. Or, on the other hand, if your car has been totaled in the wreck you will use this rental vehicle until the insurance company pays out a check for the totaled car and you can purchase a new one. You may also rent a vehicle during the time of setting up a claim and getting compensated. You will need to pay for the vehicle yourself (say if you don’t have a rental car option on your own insurance policy) and then be reimbursed for the costs later by the other driver’s insurance company. Having a rental car option on your own insurance policy is a good choice for these types of scenarios and usually tends to add very little to your monthly insurance costs. Personal injury cases involve a great deal of law that needs to be understood by your attorney if you’re looking to move forward in a lawsuit against another person.

There are some things you may not know that can be a bit shocking. Such as, in the states of Virginia and North Carolina there is law called contributory negligence that affects both drivers in a car accident very much.

Basically, contributory negligence is where if you are at fault for the accident you cannot recover any of your costs. This includes money for lost wages, doctor visits, prescription medication, medical bills, hospital stays, and any other expenses that occurred due to the accident. To be clear, this law pertains to you even if you were a little at fault. The other driver could have been the one who caused a great deal of the accident, but if you contributed to the accident even a little bit you are denied recovering any money. It is not a good idea to talk to insurance company (especially the other driver’s) since they know this law and may reinterpret your side of the events as you being at fault and you get nothing. You need to seek the assistance of an experienced attorney who understands these laws and can help you win your case against the other driver. Watch the video now to learn more.

It also has other benefits to you as well. But who protects you from the driver who doesn’t insurance or too little to cover your own injuries and medical bills? In these types of scenarios, this is where uninsured and underinsured motorist coverage is the right choice for your insurance needs. Under your insurance policy, uninsured motorist coverage allows you to receive compensation from your own insurance company when the other driver who hit you doesn’t have any insurance at all. Maybe their insurance plan only covers $10,000 of your bills, but your injuries equal up to $100,000. How do you make up the rest of those costs? With underinsured motorist coverage. It’s important when purchasing these types of insurance that you get a lot of coverage. These policies are in place to protect you in a bad situation and you need enough coverage to do that, no matter what the injuries are. Watch the video now to learn more. Whether you’ve been involved in an automobile accident, truck accident, personal injury accident, or even a wrongful death suit, we have to be able to prove that someone else was at fault for the injuries you and your family suffered.

To prove your case in court we must do several things that show you were not at fault for your accident and that the other party needs to compensation you for your damages.

After we research and investigate your case, we may believe that going to trial is the best course of action. While we’re in trial, we need to prove to the judge and the jury that you were not at fault. We do this in several ways by presenting the evidence in the case. One type of evidence you may not think of is actually visual aids for the jury. For example, if you’re injured very badly in an automobile accident, we may show the jury a set of medical illustrations that will visually be able to tell how you were injured. The visual impact of seeing the broken bones or the x-rays of the injured victim (you) can be very powerful in this type of case. Usually we can show juries what type of surgeries you had to have or may need in the future. Plus we can show how your injury is going to affect you life so that they understand at a basic level how this accident will affect your future, beyond the medical jargon and extensive doctor questions which may be hard to understand. With automobile accidents, you have a lot to worry about. You need to think about how to pay your medical bills, if your injuries may be permanent, how to fix your car, and how to recover from all this by insurance companies.

But what happens when the other driver doesn’t have insurance? That lack of insurance can mean that your medical bills, doctor visits, prescriptions and lost wages are now all on you.

What you may not know is that there is coverage to protect you in this type of situation and you can get that coverage from your own insurance company. Uninsured motorist coverage works exactly like it sounds. It protects you when the other driver doesn’t have insurance. You can choose coverage in different amounts, but it’s always good to have a lot of coverage because you may be covering everything from hospital stays to time out of work. This type of insurance can also be added compensation on top of your normal protection, helping cover the gap between how much insurance you have purchased and how much money your total bills will add up to. Don’t let someone else’s lack of insurance coverage harm you and your family, keep yourself protected and know your options. Watch the video now to learn more.

Within a personal injury case, you are trying to receive compensation from the party who causes you injury and harm in a car accident.

Damages can come as compensatory or, in some cases, punitive. Compensatory damages recover money for you for your lost wages, pain, suffering, medical bills and doctor visits. Punitive damages are quite different. These damages are placed on the offending party for doing something usually morally irresponsible.

For example, a jury may find in favor of you against a drunk driver who hit you and cause you injury. Along with compensatory damages, they award you punitive damages. This type of damage is about sending a message to any drivers who dare to drive drunk and a message to the community to show that this type of behavior is not tolerated. Punitive damages may differ from state to state, but in the state of Virginia you can be awarded up to $350,000 dollars in your personal injury case. While not every drunk driving case is awarded punitive damages, cases that reach a high blood alcohol level is typically a good indicator. An experienced attorney can help you with any questions you may have regarding your accident case. Watch the video now to learn more.

As we go to work, we may understand how the dangers that surround us on an everyday basis that we have to protect ourselves from. But no one can predict catastrophic events that come out of nowhere.

Such is the case of one young woman, a client of ours that worked at a motel as a housekeeper. She had no idea that while she was folding laundry one day that a propane truck would cause an explosion and leave her severely burned.

A faulty flange on the truck allowed gas to leak out and cause an explosion. But how were we going to be able to help her? As personal injury attorneys, we’ve seen a lot of different types of accidents but had never dealt with propane issues before. This is where our dedication to our clients really takes hold. We set out to learn everything we could about propane, the trucks that carry it, and how this accident could have possibly happened. We pride ourselves in investigating each case with the utmost persistence and dedication because we know our clients are looking for the best possible people to represent them and get them the best results for their lawsuit.
