Bus Driver Gets Justice

A plaintiff in a Richmond Circuit Court case settled his case favorably
thanks to the careful work of his Fairfax, Virginia personal injury

The plaintiff, a motor coach driver, was driving 48 high school seniors
to Disney World in April 2006 when a tractor trailer clipped his bus on
US 17 between Warrenton and Fredericksburg. As a result of the crash,
the plaintiff lost his lower left leg and foot in the crash and also
suffered a shattered right hip and knee.
It took rescue workers two and a half hours to pull the bus driver from
the wreckage, and the plaintiff first knew he had lost his leg when he
heard a paramedic say, "His leg's gone."
The plaintiff brought the matter to trial, and in fact, the jury heard
all of the evidence and had gone in the jury room to deliberate when the
parties settled. That is, the jury sat through the whole trial and was
going to render a verdict but the settlement occurred before the jury
came out to tell the parties its finding.
What helped settlement was the jury seeing a video of the plaintiff
walking his daughter down her wedding aisle on crutches with his son
behind him in case he lost balance. The jury also heard testimony that
the plaintiff now has arthritis in both knees and hips from the crash
and will have to have hip and knee replacements in the future. His past
and future medical bills are estimated at $457,000.
