Do Doctors Make Decisions about SSDI Claims?
Tuesday, April 26th, 2011
Are you wondering whether it was a doctor or some sort of bureaucrat who decided to deny your claim for Social Security Disability Insurance benefits? The answer is somewhat complex. Doctors do have input into approval or denial of SSDI benefits, but they are not the only ones. If you have been denied or are considering applying for SSDI benefits, the Social Security Disability attorneys of Kalfus & Nachman can help you better understand the SSDI system and fight to get your SSDI claim approved.
Who Denied My SSDI Benefits?
When you file a claim for Social Security Disability Insurance, the Claims Representative who receives your paperwork forwards it to the state disability agency. In Virginia, this agency is Disability Determination Services, a division of the VA Department of Rehabilitative Services. In North Carolina, your claim goes to division of the NC Department of Health and Human Services of the same name.
Disability Determination Services then assigns your case to a Disability Examiner, who is charged with making the evaluation whether you have injuries or medical conditions that qualify for SSDI benefits. Here is where the doctor comes in. The Disability Examiner can order a consultative medical evaluation in which a doctor, psychiatrist, or other medical professional determines if your injury or medical condition truly makes you unable to work. These medical evaluations are most often required in SSDI claims involving mental health or psychiatric disabilities.
Based on the doctor’s evaluation of your disability, the Disability Examiner writes up your approval or denial of SSDI benefits, which is sometimes, but not always, reviewed by another doctor.
If you have been denied SSDI benefits or need to learn more about the SSDI approval process, please contact the Social Security Disability lawyers of Kalfus & Nachman to schedule your SSDI consultation.

Darvon and Darvocet Wrongful Death Lawsuits
Wednesday, April 20th, 2011
After decades of research showed links to suicide and fatal heart rhythm abnormalities, the painkillers Darvon and Darvocet were finally recalled by Eli Lilly and Company in November 2010 at the request of the FDA. Families of those killed by Darvon and Darvocet through overdose, heart problems, and suicide are now increasingly seeking to file wrongful death claims in North Carolina and Virginia.
While the UK drug regulatory agency banned Darvon and Darvocet in 2005, it took the US Food and Drug Administration five more years before doing the same. Even then, the FDA only took action after consumer advocates at Public Citizen filed a lawsuit to encourage the FDA to look into a recall of Darvon and Darvocet.
Now that families in the Norfolk, Newport News, and Roanoke, Virginia are aware of the deadly history of Darvon and Darvocet more and more are looking into the deaths of loved ones who were taking these dangerous prescription drugs. If someone in your family died of overdose, heart arrhythmia, or suicide while taking Darvon or Darvocet , the pharmaceutical injury attorneys of Kalfus & Nachman can help you determine your legal options.
To learn if you have grounds for a Darvon/Darvocet wrongful death lawsuit in Virginia or North Carolina, please contact the experienced personal injury attorneys of Kalfus & Nachman and schedule a consultation free of charge.

Off-the-Clock Hours
Monday, April 18th, 2011
Trusting that employees do not understand their rights, some employers treat legitimate working hours as off-the-clock hours. Examples include unpaid work-related activities such as driving to and from work sites, working beyond your normal shift, mandatory meetings, and some meal or breaks.
In addition, some jobs are extremely competitive, leading workers to believe they must work long hours without pay to impress the employer and receive promotions. Furthermore, the scarcity of jobs in this economy leads some workers to keep quiet about illegal pay practices for fear of losing their jobs.
If your employer requires you to work extra hours and does not pay for this work, the Virginia employment attorneys of Kalfus & Nachman will help you determine if these off-the-clock hours are legitimate under the law. If we determine that your employer may be in violation of the Fair Labor Standards Act (FLSA) or other Virginia state and federal employment law, we will fight for your justly earned back pay and other compensation.
Legal and Illegal Off-the-Clock Hours
Certain kinds of employees, such as volunteers and independent contractors, are considered “exempt” under FLSA and not entitled to time-and-a-half overtime pay and other requirements. All too often, however, employees are labeled exempt when the terms of their employment actually do entitle them to overtime. Employers frequently misclassify workers as volunteers or independent contractors, thinking that such a label alone exempts them from paying overtime or off-the-clock hours.
If you are confused about your exempt or non-exempt status or if you believe you are being inappropriately classified as a volunteer or independent contractor, our Virginia employment attorneys will help you figure out if you are owed back pay for unpaid overtime or off-the-clock hours.
If your employer requires you to work off-the-clock hours, please contact the Virginia employment attorneys of Kalfus & Nachman today to discuss your case.

Failure to Pay Overtime
Thursday, April 14th, 2011
Under the Fair Labor Standards Act, workers are considered either “exempt” or “non-exempt” depending on the terms of their employment. Volunteers and independent contractors fall into the exempt category, which means they are not entitled to time-and-a-half pay for overtime hours. Some employers, either because they do not understand the law or intentionally to save money, classify employees who should be non-exempt as volunteers or independent contractors.
It is your relationship with your employer and the terms of your employment that determine if you are an exempt or a non-exempt employee, not what you are called in your employment agreement. If you are currently not being paid overtime to which you are entitled, our experienced Virginia employment lawyers will help you find out if you have a case. We will look at your employment agreement and have you describe your employment relationship to determine if you are exempt or non-exempt. If we find that you are a non-exempt employee who is not being paid correctly, we will fight to ensure that you are paid in full for your overtime hours worked.
