FDA Issues Maker of Zicam a Warning Letter
Tuesday, June 30th, 2009
On Tuesday, June 16, 2009, the Food and Drug Administration (FDA) issued a letter to the manufacturer of Zicam, Matrixx Initiatives, Inc., due to reports that Zicam nasal sprays, gels, and swabs are causing users of these over-the-counter homeopathic decongestant products to lose their sense of smell (anosmia). At the time of this writing, there have been over 130 reports (at the time of this writing) of Zicam users losing their sense of smell.
If you live in Virginia or northeast North Carolina and have suffered the adverse effects of Zicam, the personal injury attorneys at Kalfus & Nachman will be able to tell you whether or not you have a valid legal claim. The experienced defective drug attorneys at Kalfus & Nachman can help you recover monetary compensation for your suffering; please contact the office to schedule a confidential, no-cost consultation as soon as possible as there are time limits (statutes of limitation) on defective drug cases.
While having no sense of smell may not seem like a serious medical condition, it actually is. If you are not able to smell, then you would not smell a gas leak or something burning in your home. Also, since the sense of smell is directly tied to the sense of taste, you would not be able to taste your favorite foods. You may be able to detect spiciness or saltiness, but you would not be able to discern flavors, and everything would taste rather bland.
If you or a loved one has used Zicam and has since suffered a loss of the sense of smell or a diminished sense of smell, please contact Kalfus & Nachman, Attorneys at Law, serving Norfolk, Newport News, & Roanoke, Virginia and northeast North Carolina.

Thanks to the Supreme Court of Virginia, Insurance Companies Have to Keep Their Promises!
Monday, June 15th, 2009
In a recent case handed down by the Supreme Court of Virginia, a girl who was horribly injured in an accident is entitled to the uninsured/underinsured motorist coverage in her father’s auto insurance policy. What this means is that the Court is making the insurance companies keep their promises to you, the consumer, by increasing the money available for the girl to pay her medical bills and be compensated for her injuries.
In the past, insurance companies would contend that the underinsured policy on each of three cars insured by the same owner could not be stacked in such a way as to add the coverage of all three when a passenger is injured in one of the three cars.
However, in a very recent case, the victim’s attorney was able to show the Court that the insurance contract language at issue was ambiguously written, and so the Court permitted just this sort of stacking.
While it will not be long before insurance companies change the terms of their contracts to rule this out in the future, the Court’s ruling effectively made the insurance company keep its word. The money that father paid for his premiums was fairly put to good use, and justice was served.

Excess Zinc Buildup from Dental Cream Usage May Be Harming Consumers Even Today!
Monday, June 15th, 2009
Law firms that fight for victims’ rights are developing product liability lawsuits alleging that denture cream products cause zinc buildup in the body. Long-term usage of the product leads to problems because copper and zinc compete to bind to receptors in the victim’s body, and the body then expels the copper that is not absorbed. This zinc buildup leads to neurological problems.
People who have used the denture cream range from the elderly, who may use a full set of dentures, to younger individuals who use the cream for bridges and other devises.
GlaxoSmithKline PLC and Proctor & Gamble Company are among the manufacturers who have been identified as potential defendants. In fact, there are cases pending in federal courts in California, Colorado, Florida, New York, Ohio, Oklahoma, Pennsylvania, Tennessee and Kentucky naming these businesses or their subsidiaries as defendants.
If you believe you may have been impaired as a result of denture cream usage, and you have been using the cream for a prolonged period of time, please call us at Kalfus and Nachman, PC. Stand Up For Your Rights-Show These Companies They Should Have Cared More!

Yet Another Reason Why We Should Not Trust Insurance Companies To Look Out For Us!
Monday, June 15th, 2009
Health and life insurance companies in the United States and elsewhere have nearly $45. Billion invested in tobacco stocks, according to Harvard doctors.
The largest tobacco investor appears to be the Prudential company, with branches in the United States and the United Kingdom. It has more than $1.5 Billion invested in tobacco stocks. Several others on the list apparently have over $1 Billion in Phillip Morris and other cigarette stocks. Indeed, six other major companies that sell life, health, disability, or long-term care insurance, have major holdings in tobacco stock.
So what? Well, if you own a Billion Dollars of tobacco stock, you do not want to see it go down. You are less likely to endorse anti-tobacco legislation and other actions the health insurance industry would want to do if insurance companies really cared about consumers.
With $4.5 Billion Dollars invested in Big Tobacco, many insurers are getting money from a cancer-causing industry. At present, this is who is running our health-care system.
